Terms of use and privacy policy

1. General Conditions

a. Acceptance of Terms. By accessing IHCU’s family of websites, including www.IHCU.com and other IHCU owned websites, (collectively, “the Site”), you agree to be bound by the terms and conditions described herein (“Terms of Use”) and any subsequent changes, as it may be updated from time to time. Except as specifically stated otherwise, these Terms of Use set forth the entire understanding relating to this subject matter.

 

b. Severability. If any provision of the Terms of Use is held to be invalid or unenforceable by any law, rule, order, or regulation of any government or by the final determination of any state or federal court, all remaining provisions hereof will remain in full force and effect.

 

c. Choice of Law. By accessing the Site you agree that the statutes, laws, and regulations of the United States and the State of New York, USA, without regard to conflicts of law principles, will apply to all matters relating to use of the Site, and you agree that any litigation shall be subject to the exclusive jurisdiction of the State or Federal Courts in New York County, New York.

 

d. Foreign Access. The Site is controlled and operated in whole or in part by IHCU in the United States. IHCU makes no representation that the content in the Site is appropriate or available for use in other locations, and access to it from territories where the content may be illegal is prohibited.

 

e. Termination of Access. IHCU reserves the right in its sole discretion to refuse or terminate access to the Site by you at any time.

2. Privacy Policy

a. Anonymous Data Collection. IHCU may gather from users of the Site, non-personal identifiable information (“Non-personal Information”) that web browsers, depending on their settings, may make available. That information may include, inter alia, the user’s IP address, operating system, browser type, and the pages a user visits.
IHCU analyzes such Non-personal Information to help IHCU better understand how the Site is being used and for business and marketing related purposes. From time to time, IHCU may also share Non-personal information as collected and/or in the aggregate, with our business partners and advertisers, for marketing purposes and/or to improve acquisition channels.

 

b. Voluntary Data Submission. From time to time, when users of the Site request further information about IHCU and its program offerings, IHCU may ask for personal identifiable information (“PII”), which may include contact information, email, gender, and/or age. PII may be used for internal marketing purposes, to contact users about the program for which they have expressed interest to personalize correspondence, and/or to distinguish adults from minors. From time to time, IHCU may also use PII to offer Site users the opportunity to participate in promotions. Any PII provided to IHCU in connection with such activities will be treated in accordance with this privacy policy.

 

c. Use of “Cookies.”
1st Party Cookies
A “cookie” is a small text file placed on a user’s computer used to store information about the user. IHCU may use cookies to track the pages that users to the Site visit during their online session, for marketing and advertising purposes, to help IHCU improve users’ experiences, and/or to help IHCU understand how the Site is being used.
Users who do not wish to have cookies placed on their computers should disable cookies through their web browser settings, with the understanding that disabling cookies may diminish a user’s experience on the Site and that certain features of the Site may not function properly without the aid of cookies. Cookies are not harmful and cannot introduce viruses or extract PII.

 

3rd Party Cookies
IHCU may allow third party companies to set and access their own cookies. Such “third party cookies” are used to collect data about the Site’s traffic, for statistical analysis about the advertisements on the Site and to further customize and enhance a user’s experience on the Site. Third party cookies may also be used for traffic and conversion analysis and/or remarketing purposes, which may include, inter alia, promoting display ads based upon users’ past behavior, showing IHCU ads across the Internet and providing reporting on users’ interactions with our ad services. IHCU does not control third party cookies and third party cookies are not governed by this Privacy Policy, but rather are governed by the privacy policy of the third party companies.
Users may choose to opt out of or disable third party cookies. Advertisers may allow users to opt out of ads by visiting their websites and customizing the user’s ad settings.

 

d. Disclosure of Information. If users opt-in to receive company marketing materials or other promotional items, IHCU may provide such users’ first and last names and email and contact information to third parties, so that those third parties may fulfill such requests. As explained below, users may opt out of receiving emails from IHCU at any time. However, even after opting-out of IHCU emails, a user may continue to receive marketing emails from third parties to whom IHCU already has provided the user’s email information. Users are responsible for directly contacting such third parties to request removal from email lists.
IHCU discloses PII when required to do so by law, or when IHCU in good faith believes such action is necessary to protect the property or rights of IHCU, third parties or the public at large.

 

e. Contacting You. IHCU may use your contact information to inform you of changes to the Site, or, if requested, to send you additional information about IHCU. IHCU has a no-spam policy and provides you with the ability to opt-out of our communications by selecting the unsubscribe link at the footer of all emails. IHCU will not sell, rent or share your email address, and you may unsubscribe at any time through the unsubscribe link at the footer of all email communication.

 

f. Assignment of Rights. In the event of an assignment, sale, joint venture, or other transfer of some or all of IHCU’s assets, you agree IHCU may assign, sell, license or transfer any information that you have provided to us.

3. Intellectual Property

Any unauthorized use of any material contained on this Site may violate copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations and statutes. IHCU monitors use of its copyrighted material on the Internet and will seek legal action against any infringing parties.

 

a. Copyrights
All content found on the Site, except as noted otherwise, is exclusively and solely owned and copyrighted by IHCU and/or its affiliates and/or its licensors. No such content may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means including, but not limited to, electronic, mechanical, photocopying, recording or otherwise, without IHCU’s prior written consent. You may not “mirror” any content contained on this Site without express written consent from IHCU.

 

b. Trademarks
“International Health Coach University” and other names, logos, and marks related to IHCU and its services are trademarks and service marks of IHCU, and are protected by law. IHCU reserves all rights to its trademarks and service marks. They may be used only with the prior written permission of IHCU. Fair use of the trademarks and service marks requires proper acknowledgment.
Names, logos and marks of other entities appearing on the Site are the trademarks or service marks of those entities, and their appearance on the Site does not imply the endorsement of IHCU by or affiliation of IHCU with those entities, except as expressly indicated. Users are not permitted to use any of these third party trademarks, logos and/or service marks without prior written consent from the respective rights holder.

 

c. Digital Millennium Copyright Act (DMCA) Notice
IHCU respects the rights of other copyright holders. If you believe your copyright is being infringed, IHCU will respond to notices of alleged infringement submitted in accordance with 17 USC §512(c)(3).

4. Security

IHCU takes reasonable precautions to protect information that has been provided to IHCU by Site users. When users submit sensitive information via the Site, all information is protected both online and off-line. However, due to the nature of the Internet, IHCU cannot completely ensure, guaranty, or warrant the security of any information transmitted to us or through our Site. Submitting information is done at your own risk. IHCU has security measures in place to prevent the loss, misuse, and alteration of the information that IHCU obtains from you, but IHCU makes no assurances about our ability to prevent any such loss, misuse, to you or to any third party arising out of any such loss, misuse, or alteration.

5. Third Party Links

The Site may contain links to third-party websites that are not controlled by IHCU. If you choose to visit such websites, IHCU is not responsible for the privacy practices or content of those websites, and it is your responsibility to review the terms and privacy policies of those websites to confirm that you understand and agree with their policies.
